    The major problem with the DOJ position is that the executive branch thereby effectively seeks to impose on Congress its own definitional limitations and interpretation of what is a purely legislative matter under the Constitution. The congressional power of determining its own rules governing adjournments and recesses is key to the effective separation of powers between the three branches of government. As such, Congress is the only legal interpreter of its own operational rules and manner of proceeding. DOJ has effectively overstepped the line here.
