October 23, 2012 — This week on “Off the Shelf,” David Dowd, partner at Mayer Brown LLP, discusses three significant bid protests involving blanket purchase agreements (BPAs) issued under the General Services Administration’s multiple award schedule (MAS).

In the Verizon Wireless bid protest involving GSA strategic sourcing BPA for wireless, the Government Accountability Office (GAO) struck four BPA terms that where now shown to be consistent with commercial practice.

David also highlights two other major protests addressing the consideration of price in the evaluation and establishment of MAS, BPAs. Finally, David provides his take on what these changes mean for government, MAS contractors and the future use of MAS, BPAs.
