Issa seeks answers on layoff notices from defense companies

Chairman of the House Oversight and Government Reform Committee Darrel Issa (R-Calif.), wrote to the heads of 10 defense companies seeking information about the legal justification for not issuing notices of potential layoffs due to the across-the-board defense cuts set to go into effect Jan. 2. If contractors don't issue the notices and contracts are, in fact, terminated or modified, then agencies will pick up the contract-termination and employee compensation costs, the Office of Management and Budget stated in guidance issued late last month. But Republican lawmakers have argued the White House doesn't have the legal authority to ask companies to not comply with the law.

    Yo know why... because the great and powerful Obama doesn't want pink slips going out days before the election...and that's the bottom line. It's totally illegal too, and I'm pretty sure he won't be able to get away with it.

    The WARN Act clearly says that notifications are required 60 days or more before a layoff or plant closure. Not a potential layoff. An *actual* layoff. An employer does not have to notify employees if there's a chance that they may be laid off. It also only affects a "mass" layoff, which is defined as 30 or more days of layoffs for 33% or more full-time employees or 500 or more full-time employees. What is the exact number of FTE layoffs at each company? No one knows because it's not final. If 499 FTEs are being laid off and that accounts for 30% of the company's FTE count, the WARN Act wouldn't apply.

    If I get a pink slip, I promise the incumbent will NOT get my vote. On the other hand, if I don't get a pink slip, I promise I'll cast my vote for the challenger.
